Terms of use (Platform terms / CGU)

These Terms of Use govern the use of the LetFlat.net platform and are binding on all users of the website.

1. General provisions

1.1. LetFlat.net is an online service intended for the publication and viewing of long-term residential rental listings, as well as the use of related platform services.

1.2. The platform operator is:

1.3. By using the platform, the user confirms that they have read these Terms, understood their content and accepted them in full.

1.4. If the user does not agree with these Terms, they must immediately stop using the platform.

2. Definitions

For the purposes of these Terms, the following definitions apply:

  • Platform means the LetFlat.net website and the services associated with it;
  • User means any person using the platform;
  • Landlord means a user posting a listing to rent out accommodation;
  • Listing means a property card published or prepared for publication on the platform;
  • Content means any information posted by the user on the platform, including texts, photos, images, contact details and other materials;
  • Paid Services means any paid platform feature, including listing promotion, highlighting, advertising and other services;
  • Moderation means automated and/or manual review of listings and other content for compliance with platform rules and applicable law.

3. Purpose of the platform

3.1. LetFlat.net gives users the technical ability to:

  • create accounts;
  • publish long-term rental listings for studios and apartments;
  • browse listings;
  • contact users who posted listings directly through the contact details they provided;
  • use additional paid and technical platform services.

3.2. LetFlat.net is not a real estate agency unless expressly stated otherwise.

3.3. LetFlat.net is not a party to the rental agreement, does not negotiate on behalf of the parties and does not represent either the landlord or the tenant.

3.4. LetFlat.net does not charge any commission on rent or on a transaction between users.

3.5. LetFlat.net does not guarantee:

  • the successful rental of an apartment;
  • the successful search for accommodation;
  • the conclusion of a contract between users;
  • the accuracy of all information posted by users;
  • that any listing or user on the platform will meet a user’s expectations.

4. Access to the platform

4.1. Access to some platform functions may require account registration.

4.2. The user undertakes to use the platform in good faith, lawfully and only for purposes consistent with the intended purpose of the platform.

4.3. LetFlat.net may change, restrict, suspend or terminate access to individual platform functions at any time for technical, organisational, legal or other reasons.

4.4. LetFlat.net does not guarantee uninterrupted and continuous operation of the platform 24/7.

5. Registration and user account

5.1. To access certain functions of the platform, the user may register an account.

5.2. During registration, the user must provide accurate and up-to-date information.

5.3. At the current stage, the platform stores only the following data in the user account:

  • e-mail address;
  • account password hash;
  • verification codes for registration, login and password reset;
  • name / agency name;
  • WhatsApp;
  • contact type: owner / real estate agency / private individual;
  • technical authentication data necessary to maintain the user session.

5.4. The user is responsible for keeping their login credentials secure and for all actions performed through their account.

5.5. LetFlat.net may treat actions carried out through the user’s account as actions of that user until it receives proper notice that the account has been compromised.

5.6. Account deletion is carried out through a support request sent to rills@rills.top.

6. Who may use the platform

6.1. The platform may be used within the limits permitted by applicable law.

6.2. Any user carrying out legally relevant acts on the platform, including publishing listings and purchasing paid services, must have the legal capacity required under applicable law.

7. Listing publication

7.1. Only listings for long-term residential rental properties may be posted on the platform, namely:

  • studios;
  • apartments.

7.2. A user publishing a listing undertakes to provide only accurate, up-to-date and non-misleading information.

7.3. The following fields are mandatory for publication:

  • title;
  • description;
  • price;
  • address;
  • district / arrondissement;
  • surface area;
  • apartment type;
  • number of bathrooms;
  • photos.

7.4. At least 2 photographs are required to publish a listing.

7.5. A listing may include user contact details, including:

  • e-mail;
  • WhatsApp.

7.6. Listings may be posted on the platform by:

  • owners;
  • real estate agencies;
  • private individuals.

7.7. LetFlat.net does not automatically prohibit listings relating to subletting. However, the user remains fully responsible for the lawfulness of such publication and for having all necessary permissions and legal grounds.

8. User obligations when publishing a listing

8.1. By publishing a listing, the user confirms and warrants that:

  • they are entitled to publish the listing;
  • they have lawful grounds to offer the property for rent;
  • the information provided is accurate;
  • the materials posted do not infringe the rights of third parties;
  • the listing does not violate the law, the owner’s rights, third-party rights, contractual terms, building rules or any other mandatory requirements.

8.2. The user alone is responsible for:

  • the right to rent out the property;
  • the lawfulness of any subletting;
  • the accuracy of contact details;
  • the content of the listing;
  • the listing’s compliance with applicable law.

8.3. LetFlat.net does not verify:

  • the legal status of the property;
  • the existence of the right to rent it out;
  • the lawfulness of subletting;
  • the identity of the posting user, other than e-mail verification;
  • the property’s compliance with legal requirements applicable to residential letting.

9. Prohibited conduct

Users are prohibited from:

  • 9.1. Publishing false or misleading listings.
  • 9.2. Posting duplicate listings without reasonable grounds.
  • 9.3. Posting spam, mass junk listings or otherwise abusing the platform.
  • 9.4. Using discriminatory wording or criteria.
  • 9.5. Using the platform for unlawful subletting, fraud or circumvention of the law.
  • 9.6. Posting listings unrelated to long-term residential rental within the permitted categories.
  • 9.7. Posting malicious links, viruses, scripts or other dangerous elements.
  • 9.8. Impersonating another person or misleading users as to identity or status.
  • 9.9. Posting abusive, threatening, unlawful or otherwise unacceptable content.
  • 9.10. Using the platform for commercial purposes inconsistent with LetFlat’s intended purpose.

10. Moderation and platform measures

10.1. LetFlat.net may moderate listings and other user content.

10.2. The platform may, at its discretion and without prior notice where the breach is manifest:

  • reject a listing;
  • temporarily hide a listing;
  • request corrections;
  • delete a listing;
  • restrict access to functions;
  • temporarily or permanently block an account.

10.3. Such measures may be based on:

  • breach of these Terms;
  • breach of law;
  • a third-party complaint;
  • signs of fraud;
  • manifest inaccuracy of a listing;
  • discriminatory content;
  • spam;
  • unlawful subletting;
  • other risks for users, the platform or third parties.

10.4. The user may contact support and submit an appeal against a platform decision to rills@rills.top.

11. Complaints and notices

11.1. Any user or third party may submit a complaint about a listing or content to rills@rills.top.

11.2. Complaints may relate in particular to:

  • fraud;
  • fake listings;
  • unlawful subletting;
  • discrimination;
  • spam;
  • duplicates;
  • breach of platform rules;
  • infringement of third-party rights.

11.3. LetFlat.net reviews complaints within a reasonable period and may take action without prior notice where a clear breach exists.

12. Paid services

12.1. The platform may provide paid services, including:

  • bumping a listing higher in the list;
  • highlighting a listing;
  • banner and third-party advertising placements;
  • document scanning;
  • dossier assembly;
  • other services made available on the platform.

12.2. Paid services may be available to private individuals, professional users and external advertisers depending on the type of service.

12.3. Some services may be purchased online without manual confirmation by the platform. Advertising placement may require separate approval.

12.4. Terms relating to payment, activation, refunds, limitations of liability and special conditions for paid services are set out in the separate document “Paid Services Terms (CGV)”.

13. Document scanning and dossier assembly

13.1. LetFlat.net may provide technical services for:

  • document scanning;
  • assembling a user dossier from a template.

13.2. As part of the dossier assembly service, the platform performs only a technical function by compiling the data entered by the user into a template document.

13.3. LetFlat.net:

  • does not guarantee that such a dossier will be accepted by a landlord, agency or third party;
  • does not provide legal, financial or immigration advice;
  • does not determine which documents the user must provide in a particular situation.

13.4. The user alone is responsible for:

  • the lawfulness of the documents used;
  • the accuracy of the data entered;
  • having the right to transmit documents;
  • not including unnecessary or third-party personal data without a lawful basis.

13.5. The terms applicable to document-related services may be governed by a separate document.

14. User content

14.1. The user retains rights to their content unless otherwise provided by law.

14.2. By posting content on the platform, the user grants LetFlat.net the right to use it to the extent necessary for:

  • storage;
  • display;
  • publication;
  • moderation;
  • technical processing;
  • promoting the listing within the platform.

14.3. The user warrants that their content does not infringe the rights of third parties.

15. Personal data and cookies

15.1. Personal data is processed in accordance with the platform’s Privacy Policy.

15.2. The use of cookies, analytics, marketing tools and other tracking technologies is governed by the Cookies and Tracking Policy.

16. Deletion of accounts and listings

16.1. The user may contact support and request deletion of their account.

16.2. Once the account is deleted, the user’s listings are deleted.

16.3. Listings remain on the platform until the user deletes them, unless a longer retention period is required by law or by the platform’s legitimate need.

16.4. If the user deletes a listing themselves, that listing is removed from the platform.

17. Limitation of platform liability

17.1. LetFlat.net provides the platform “as is” to the extent permitted by applicable law.

17.2. LetFlat.net is not liable for:

  • the content of user listings;
  • acts or omissions of users;
  • negotiations between users;
  • the conclusion or non-conclusion of rental agreements;
  • the accuracy of information posted by users;
  • the quality, condition, availability or lawfulness of any property;
  • the conduct, good faith or solvency of users;
  • direct or indirect losses arising from interactions between users.

17.3. LetFlat.net does not guarantee uninterrupted operation of the platform, the absence of errors, permanent availability of all functions or that the platform will meet a specific user’s expectations.

17.4. Nothing in these Terms excludes or limits liability to the extent that such liability cannot be excluded under applicable law.

18. Support and dispute resolution

18.1. For any question, the user may contact: rills@rills.top

18.2. Before resorting to any other remedy, the parties seek to settle the dispute through support and a prior complaint procedure.

18.3. Where applicable law requires that a consumer be given access to mediation, the relevant information is published separately by the platform and/or in documents relating to paid services.

19. Applicable law

19.1. These Terms are governed by the law determined in accordance with applicable conflict-of-law rules and mandatory consumer protection provisions.

19.2. In relations with consumer users, no provision of these Terms deprives them of the protection afforded by the mandatory rules of the country of their habitual residence, where such rules apply.

20. Amendments to the Terms

20.1. LetFlat.net may amend these Terms at any time.

20.2. The updated version takes effect upon publication on the platform unless otherwise expressly stated.

20.3. Continued use of the platform after publication of a new version means acceptance of the amendments.
